1. Agreement to Terms

By accessing or using PaintWiser ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including the web application, mobile applications, and any related services.

2. Description of Service

PaintWiser is a software-as-a-service (SaaS) platform designed to help painting contractors create estimates, manage customers, and run their business more efficiently. The Service includes:

  • Painting estimate and quote creation tools
  • Customer relationship management features
  • Offline-capable mobile and web applications
  • Data synchronization across devices

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription and Payment

Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the subscription fees indicated for that plan.

Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. Your subscription will automatically renew unless you cancel it before the renewal date.

All payments are processed securely through Stripe. We do not store your credit card information on our servers.

5. Free Trial

We may offer a free trial period for new users. At the end of the free trial, you will need to subscribe to a paid plan to continue using premium features. We will notify you before your trial expires.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

We generally do not provide refunds for partial subscription periods. However, if you believe you are entitled to a refund, please contact us and we will review your request on a case-by-case basis.

7. Acceptable Use

You agree not to use the Service:

  • For any unlawful purpose or to violate any laws
  • To harass, abuse, or harm another person
  • To impersonate any person or entity
  • To interfere with or disrupt the Service or servers
  • To attempt to gain unauthorized access to any part of the Service
  • To transmit viruses, malware, or other malicious code
  • To scrape, data mine, or use automated means to access the Service

8. Your Data

You retain all rights to the data you input into the Service, including customer information, estimates, and business data ("Your Data").

By using the Service, you grant us a limited license to use, store, and process Your Data solely for the purpose of providing the Service to you.

You are responsible for maintaining backups of Your Data. While we implement reasonable measures to protect your data, we are not liable for any loss of data.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • Any errors in the Service will be corrected

Important: Estimates and calculations generated by PaintWiser are provided as tools to assist you. You are solely responsible for verifying all calculations and estimates before presenting them to your customers. We are not liable for any losses resulting from inaccurate estimates or calculations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINTWISER AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or data corruption
  • Loss of goodwill or reputation
  • Cost of procurement of substitute services
  • Any damages arising from estimates or calculations provided by the Service

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless PaintWiser and its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Intellectual Property

The Service and its original content, features, and functionality are owned by PaintWiser and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the software.

13. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. You may request a copy of Your Data within 30 days of termination.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
